Buying a home? What your real estate lawyer does

From reviewing the agreement to handing you the keys on closing day, here is what happens behind the scenes when you buy a home in Ontario.

Before you sign the offer

If you can, have a lawyer look at the agreement of purchase and sale before you sign. Conditions such as financing and a home inspection protect you if something goes wrong.

After your offer is accepted

Send us the signed agreement, your mortgage lender's details and your home insurance information. We search the title to confirm the seller owns the property and that there are no unpaid debts, liens or work orders attached to it, and we arrange title insurance.

In the week before closing

  • We prepare your mortgage documents with your lender
  • We calculate the land transfer tax and prepare the statement of adjustments
  • You sign the documents with us and provide the balance of the down payment
  • We confirm the seller's side is ready

On closing day

We register the transfer electronically, send the funds to the seller's lawyer and release the keys to you. You then receive a final report with your registered documents.

Costs to budget for

  • Land transfer tax (in Toronto, both Ontario and Toronto; first time buyers may get rebates)
  • Legal fees and disbursements
  • Title insurance
  • Adjustments, such as property tax the seller already paid
